$500 a Day Holiday Giveaway Contest - 2009
Sponsored by Progressive Casualty Insurance Company, 6300 Wilson Mills Road, Mayfield Village, Ohio 44143 (the “Sponsor”).

OFFICIAL RULES

NO PURCHASE OR RATE QUOTE IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED.

1. Sweepstakes Period: Progressive Commercial's $500 a Day Holiday Giveaway (the “Sweepstakes”) begins on January 1, 2010, at 12:00 AM (EST) and ends on January 31, 2010, at 11:59 PM (EST) (the “Sweepstakes Period”). Promotion Period will be divided into thirty-one (31) individual Daily Entry Periods, as defined below.
2. How to Enter: Visit http://www.progressivecommercial.com/contests/holiday-contest.aspx during the Promotion Period and follow the instructions provided to complete and submit the Official Entry Form. All entries must be received by 11:59:59 pm ET to be eligible for that Daily Entry Period's drawing. Only one (1) entry per person and e-mail address will be accepted per day. In case of multiple entries on any day from any one person or e-mail address, only the first entry received on such day will be accepted. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned.
   
   By participating, entrants consent to the use of their submitted e-mail and street address by Sponsor for the purpose of sending promotional e-mails and direct mail to entrants or to offer information on other offers or products or services. Entrants may opt-out of receiving such e-mails or direct mail at any time and doing so will have no impact on their chances of winning. By entering the Sweepstakes, you understand and agree that (except in Tennessee and where prohibited by law) Sponsor may use and publish the names and likenesses of winners for publicity and marketing purposes.
3. Eligibility: The Sweepstakes is open to legal residents of the 50 United States and the District of Columbia. To be eligible you must be eighteen (18) years or older by the date of entry. The Sweepstakes, and any web site pages and advertisements relating thereto, are intended for viewing within these participating states only. Employees of Sponsor, its affiliates or agents, and the immediate family members of all such individuals, are not eligible to participate in the Sweepstakes. In the event of a dispute as to the identity of an entrant based on the e-mail address submitted, entry will be awarded to the person named on the applicable entry (regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted), provided such individual is eligible according to these Official Rules.
4. Prize: Thirty-one (31) Daily Prizes (one (1) per Daily Entry Period): $500 (awarded in the form of a check). The prizes are expressly limited to the items listed above and do not include any other accessories, services, or expenses. Prizes limited to (1) prize per person and email address for the Promotion Period. Any income taxes are the responsibility of each prize winner. Sponsor reserves the right to substitute a prize of equal or greater value. Total Approximate Retail Value of all prizes = $15,500. Limit one (1) prize per person, per household and per email address.
5. Drawing and Notification: One (1) potential Daily Prize winner will be randomly selected from among all eligible entries received during each applicable Daily Entry Period throughout the Promotion Period for a total of thirty-one (31) Daily Prize winners. Each Daily Entry Period is one (1) day in length and begins at 12:00:00 am ET on each day throughout the Promotion Period and ends at 11:59:59 pm ET of the same day. Entries for one drawing will not carry forward to subsequent drawings. All drawings will be conducted after 2/1/2010. Potential winners will be notified by telephone and/or email and/or overnight mail and/or regular mail. Odds of winning any drawing will depend on the total number of eligible entries received for the applicable drawing. Potential Daily Prize winners will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release (where legal) within ten (10) days of date of issuance of notification. Noncompliance with the above, with these Official Rules, the inability of Sponsor to contact a potential winner within a reasonable time period or a prize or prize notification being returned as non-deliverable, may result in disqualification and, at Sponsor's discretion, an alternate winner being selected in a random drawing from all eligible entries received for the drawing at issue.
6. General Conditions: All federal, state, and local laws apply. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants agree that the Sponsor, its affiliate companies, parents, subsidiaries, and all of their respective officers, directors, employees, representatives, and agents shall not be responsible and will have no liability whatsoever for losses or injuries of any kind resulting from participation in this Sweepstakes including, but not limited to: any injury or damage to person or property while attending any function which is part of or related to any prize; the acceptance/possession and/or use/misuse of any prize; any injury or damage to entrant’s or third person’s property related to or resulting from any part of the Sweepstakes; or any technical malfunctions of the entry system including computer online system, computer dating mechanism, software, or any combination thereof. Sponsor shall have no liability for any illegible, damaged, lost, forged, mutilated, tampered with, incomplete, or late entries or entries not in compliance with these Official Rules and such entries will be disqualified. Any and all warranties and/or guarantees on a prize (if any) are subject to the manufacturer’s terms therefore, and winners agree to look solely to such manufacturer for any such warranty and/or guarantee. Sponsor reserves the right to change and modify these Official Rules at any time, and in its sole discretion, to cancel, terminate, suspend, or amend this Sweepstakes for any reason including but not limited to a virus, bugs, non-authorized human intervention or other cause beyond the control of Sponsor, which corrupt or impair the administration, security, fairness, or proper play of the promotion.
   
   ANY PERSON ATTEMPTING TO DEFRAUD OR IN ANY WAY TAMPER WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES WILL BE INELIGIBLE FOR PRIZES AND MAY BE PROSECUTED TO THE FULL EXTENT OF THE LAW. SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH PERSON.
7. List of Winners and Official Rules: After the Promotion Period, a winners list may be requested until March 1, 2010 by mailing to “Progressive Commercial's Holiday Giveaway” 747 Alpha Dr. - Floor 1, Highland Heights, OH 44143-2124.
