Delaware commercial auto insurance requirements

Delaware state law requires all commercial auto policies to have a minimum liability limit of $25,000 per person, $50,000 per accident for bodily injury and $10,000 for property damage (i.e. 25/50/10). Some policies are required to carry higher limits based on the types of vehicles they insure.

The state also requires you carry personal injury protection (PIP) to pay for the medical expenses and lost wages of your drivers and passengers regardless of who is at fault for an accident. Delaware is considered a “no-fault” state, meaning that you can only sue an at-fault driver for injuries once this coverage has been exhausted.

You might be required to carry higher limits based on the types of vehicles listed on your policy. You should consider selecting limits that are best for your business in addition to what’s required by Delaware state law.
